This Privacy Policy applies to FYNTech ("we", "us", "our"). We are a New Zealand technology company that builds software platforms and tools for the finance industry, including our flagship product Fynix — a CRM for asset finance brokers, car dealerships, and finance companies.

We are the "agency" responsible for your personal information under the New Zealand Privacy Act 2020.

2. What information we collect

We collect two types of information: information about our customers (brokers, dealerships, finance companies) and their end clients (borrowers, applicants).

About you (our customer)

  • Name, email address, phone number, job title
  • Business name, ABN/NZBN, and business address
  • Billing and payment information (processed securely via our payment provider)
  • Account login credentials
  • Usage data — features used, pages visited, actions taken within Fynix
  • Support and communication history

About your clients (entered into Fynix by you)

  • Full name, date of birth, contact details
  • Employment and income information
  • Financial information (assets, liabilities, credit history)
  • Identification documents (driver's licence, passport)
  • Loan application details and deal history
  • Lender communications and settlement records
When you enter your clients' personal information into Fynix, you become responsible for ensuring you have their consent to do so under the NZ Privacy Act 2020. FYNTech acts as a data processor on your behalf for this information.

3. How we collect information

We collect information in the following ways:

  • Directly from you — when you sign up, fill in forms, contact us, or enter data into Fynix
  • Automatically — through cookies, log files, and analytics tools when you use our website or platform
  • From third parties — such as lenders or verification services where relevant to operating the platform

4. Why we collect and use it

We collect and use personal information for the following purposes:

  • To provide, operate, and maintain the Fynix platform
  • To create and manage your account
  • To process payments and manage your subscription
  • To send you product updates, support responses, and service communications
  • To improve and develop our products based on how you use them
  • To comply with our legal obligations under New Zealand law
  • To detect, prevent, and respond to fraud, security incidents, or misuse
  • To contact you about new features, products, or services (you can opt out at any time)

We will not use your information for any purpose that is incompatible with the reason it was collected without your consent.

5. How we store and protect it

FYNTech takes data security seriously. We implement industry-standard safeguards including:

  • Encryption in transit (TLS/HTTPS) and at rest
  • Access controls and role-based permissions within our systems
  • Regular security reviews and monitoring
  • Secure, reputable cloud infrastructure providers

We store data in New Zealand and Australia where operationally possible. Where data is processed or stored outside New Zealand, we ensure that appropriate safeguards are in place consistent with the Privacy Act 2020.

No method of transmission or storage is 100% secure. While we take all reasonable steps to protect your information, we cannot guarantee absolute security.

6. Who we share it with

We do not sell your personal information. We may share it only in the following circumstances:

  • Service providers — trusted third parties who help us operate the platform (e.g. cloud hosting, payment processing, email delivery, analytics). These providers are contractually required to protect your information.
  • Lenders and financial institutions — only where required to process applications you initiate within Fynix
  • Legal requirements — where required by law, court order, or regulatory authority
  • Business transfers — in the event of a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you in advance.

7. How long we keep it

We retain personal information for as long as necessary to fulfil the purposes for which it was collected, including:

  • For the duration of your active subscription with FYNTech
  • As required by New Zealand law (e.g. financial records — typically 7 years)
  • To resolve disputes or enforce our agreements

When your account is closed or data is no longer required, we will securely delete or anonymise it within 90 days, unless a longer retention period is required by law.

8. Your rights

Under the New Zealand Privacy Act 2020, you have the right to:

  • Access — request a copy of the personal information we hold about you
  • Correct — request that we correct any inaccurate or incomplete information
  • Delete — request deletion of your personal information (subject to legal retention requirements)
  • Object — object to us using your information for marketing purposes at any time
  • Complain — lodge a complaint with the Office of the Privacy Commissioner at privacy.org.nz if you believe we have breached your privacy

9. Cookies and tracking

Our website and platform use cookies and similar technologies to:

  • Keep you logged in to Fynix

You can control cookies through your browser settings. Disabling certain cookies may affect the functionality of the Fynix platform.

We do not use cookies for cross-site advertising or sell cookie data to third parties.

10. Third-party services

Our platform may integrate with or link to third-party services (e.g. lender portals, document verification, payment processors). These services have their own privacy policies, and we are not responsible for their practices. We encourage you to review their policies before use.

11. Children's privacy

Fynix is a business-to-business platform intended for use by adults operating in the finance industry. We do not knowingly collect personal information from individuals under the age of 18. If you believe a minor's information has been provided to us in error, please contact us immediately.

12. Changes to this policy

We may update this Privacy Policy from time to time to reflect changes in our practices, legal requirements, or the way we operate. When we make significant changes, we will:

  • Update the "Last updated" date at the top of this page
  • Notify active Fynix users by email at least 14 days before changes take effect

Your continued use of FYNTech products after changes are in effect constitutes your acceptance of the updated policy.
